Welcome to Nunuzi! These Terms of Service ("Terms”) govern your access to and use of the Nunuzi website, mobile application, and related services (collectively, the "Platform”), owned by Mamagas & Power Limited and operated by Saron Management Group Ltd ("we,” "us,” or "our”).

 

By accessing or using the Platform, you agree to comply with and be bound by these Terms. If you do not agree, you must not use the Platform.

1. Eligibility

 

You must be at least 18 years old and legally capable of entering into a binding agreement under Kenyan law to use the Platform. By using the Platform, you represent and warrant that you meet these requirements.

2. Platform Overview

 

Nunuzi is an e-commerce and logistics platform that connects merchants, home businesses, SMEs, and customers, enabling them to showcase, order, and deliver products.

We currently operate in Nairobi, Mombasa, Kisumu, Nakuru, Kericho, Eldoret, Nyeri offering:

• Online product ordering
• Rider-based delivery
• Real-time merchant and rider settlements
• Secure payment collection
• Transaction management and tracking

3. User Accounts

 

To access certain features, you may need to create an account. You agree to:

• Provide accurate, current, and complete registration details
• Keep your login credentials confidential
• Be responsible for all activities carried out under your account

 

We reserve the right to suspend or terminate any account found in violation of these Terms.

4. Merchant Terms

 

Merchants using the Platform agree to:

• List only genuine, deliverable products or services
• Honor advertised prices, offers, and delivery timelines
• Keep stock and availability updated in real time
• Comply with Nunuzi’s pricing and commission structure (currently 15% per transaction)

 

We reserve the right to suspend or remove merchants for non-compliance, fraud, or repeated customer complaints.

5. Customer Terms

 

Customers using the Platform agree to:

• Provide accurate delivery details
• Make timely payments for confirmed orders
• Treat merchants, riders, and support staff with courtesy

 

We are not liable for failed or delayed deliveries caused by inaccurate details or lack of cooperation from customers.

6. Payments and Fees

• Payments are processed through secure, third-party payment partners.
• By placing an order, you authorize us to process the applicable product costs, fees, commissions, and charges.
• Prices may include delivery fees, platform service charges, and applicable taxes.

7. Deliveries

• Delivery timelines vary based on merchant, location, and rider availability.
• While we aim for same-day delivery, actual delivery times may be affected by distance, stock, or traffic conditions.
• Customers will receive tracking updates whenever possible.

8. Cancellations & Refunds

• Orders can be canceled before dispatch.
• Refunds are subject to merchant approval and an internal investigation.
• Nunuzi reserves the right to make the final decision in any dispute between merchants, customers, or riders.

9. Prohibited Conduct

 

You agree not to:

• Use the Platform for illegal or fraudulent activities
• Interfere with or compromise Platform security or operations
• Post false, misleading, or harmful content
• Attempt to reverse-engineer, copy, or replicate the Platform’s technology

10. Intellectual Property

 

All content, trademarks, software, and designs on the Platform are the exclusive property of Mamagas & Power Limited or its licensors. You may not copy, reproduce, modify, or distribute any part of the Platform without prior written consent.

11. Disclaimer of Warranties

 

The Platform is provided "as is” and "as available” without warranties of any kind. We do not guarantee:

• The accuracy, reliability, or availability of the Platform
• The quality, safety, or legality of products or services sold by third-party merchants

 

Your use of the Platform is entirely at your own risk.

12. Limitation of Liability

 

To the maximum extent permitted by law, Mamagas & Power Limited, Saron Management Group Ltd, and their affiliates are not liable for:

• Any indirect, incidental, or consequential losses
• Damages from delays, delivery failures, or defective products
• Unauthorized access to your account or personal data

13. Termination

 

We may suspend or terminate your account without notice if you:

• Breach these Terms
• Misuse the Platform or engage in fraudulent activities

 

You may also close your account at any time.

14. Governing Law & Dispute Resolution

 

These Terms are governed by the laws of Kenya. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the Kenyan courts.

15. Changes to Terms

 

We may amend these Terms at any time. Updated versions will be posted with the "Last Updated” date, and continued use of the Platform will be deemed acceptance of the revised Terms.
